All these people with the bad loans are getting them restructured for better deals because they cant afford their monthly payments. Is there a way to do this even if you are not having a problem making your mothly payment? Refinancing isnt an option since the price of my house is down from where I bought it. Should I got buy a car so that I cant afford my house payment and get a better deal? Most places wont re-finance since I owe more than the house is worth.

Say, for the sake of arguement, that I currently have a mortgage for 100K. I heard that I can refinance my home (at whatever the current market interest rate is, which just happens to be lower then what I'm currently at) and instead of simply refinancing and continuing with a 100K mortgage, I can instead take out a 150K mortgage. I would then essentially have 50K profit to turn around and make improvement on my house or otherwise pay other debts.
Is this true? Any info would be helpful, seems too good to be true because I'm getting ready to refinance anyway and if I could knock out a few home improvements and pay of some debts and just end up paying an extra ~$100 more a month for my mortgage, that would be great.

In 1985, my grandmother, father and stepmother bought a house under a land contract which stipulated that it was a joint tenancy with full rights to survivors. In 1992, that page was amended because they refinanced the property to get a lower interest rate. The jt. tenancy language was omitted (probably by error). In Nov. 1993, they got a warranty deed on the property, and the deed was silent, creating a tenants in common situation. In Dec. 1993, my grandmother created a will leaving her 50 percent interest in the property to me. She died this year and I executed her will. Now father and step-mother are protesting saying that the tenants in common situation was a mistake and are threatening legal action to reform the 1993 deed to a jt. tenancy situation, thus taking me out of the picture. Can they do that?

Open Question: Refinance. How long should the process take?

What happens if we go into forclosure with the possible loss the lenders take / housing slump these units in this complex 1 bedrooms now go for 129,000. We cant even sell it to recoup.
1bedrooms are hard to sell. We cant afford the mortgage unless we get debt consolidation and so far we havent found a lender that would even consider refinancing a home that is already loosing 30k in value.
Can we be sued for the 30k loss ? What if they garnish wage for rest of husbands life of working? and we cant afford to live anywhere with money being garnished.. Im the wife i dont work i dont have a car, is it better to pay all our credit card bills and let it forclose or keep tryin to get someone to refinance with debt consolidating? if i had a car i could look for work but not with one car impossible for us. heard that lenders can sue for deficeit balance. How can they get blood from a turnip? I might add that I can not take a bus i am slightly handicapped and health reasons i cant walk far bad ankle injury, bad back. so walking is not an option.
If they sue us, for the loss, and we cannot file bankruptcy after the foreclosure due to we had a bankruptcy 9 yrs ago. then i guess we just suffer not owning a home. I am perfectly happy with renting again having worried to death about where money will come from never have had a problem as a renter paid excellent rental payments.
Only thing i could think is the loan is completely in his name. I am not even on the title of the loan tho i am married to him. Since i havent worked in 7yrs due to health issues, i am unsure if it damages my credit as well. Anyone? oh ya and cant rent it out for the amount of the mortgage LOL / i think they saw us coming.
1400.00 a month for a condo mortgage .. 1 bed 1 bath.. you wont get more then 800 a month if that for rent, so no point in renting and paying someones rent of the other 500 a month wed not be able to afford to live period easiest thing would be to get the debt consolidation loan then we could pay the mortgage.. but doubtful anyone will give us debt consolidation. thanks for the info thus far

Open Question: investing in multi-family houses to rent them out...suggestion and advice please?


I met a man one day that made 17k a month from his 21 propeties he own he is 29 and live off his houses....I want to be like that but I will still work.

so what can I do with 60k in Lehigh valley Allentown PA? the multi family houses are roughly 160-200k and I want to start owning houses and be like that man...unfortunately he did not want to give me any advice...said learn the hard way like me.

anyway what can I do with 60k I have from working these past 2 years in terms of investing...I have a 721 credit

so I'm thiking about giving a 10% down on 3 apartments which should be like 55k and the houses should pay for them selfs and bring me from 500-1000 dollars a month each then some months later refinance all 3 for 6k each and buy a 4th and so on.

Open Question: Refinance. How long should the process take?


I began the process on September 20th and did have to fax in a few things to clear up some credit reporting questions. The appraisal was done about 3 weeks ago but my loan officer with countrywide always says he is waiting for the underwriter. What should I do?

Do I have to spend the money in year 2007? Because the government will use year 2008 tax return to determine a family’s financial capability. Most of my money is in high interest rate CD and will mature in year 2008. I want to collect the interests in year 2008; then put them into my mortgage as principal. I have not thought to refinance my mortgage yet. I do not know should I continue to benefit the current low rate mortgage, which I can save more and wait to see what will happen in year 2010 (the time, either mortgage rate goes very high, I have to refinance or the mortgage rate is OK, I stay in my current mortgage agreement. It is a gambling), or refinance now. Is getting a loan for my daughter’s college education a good idea? I hate to borrow money in general. I might change job after my daughter goes to college. That means I might have to change location and sell the house. But truly I do not what will happen in the future several years.

Open Question: Refinancing / Selling with HOA suit in progress.?


I am currently in a situation where my HOA is suing the contractor that upgraded my condos. I am needing to either sell or refi or I will be forced to forclose. Ive tried to refinance but lendors will not accept me due to that major factor. Can I put in a civil suit to the contractor or other type of suit I can do so If i do loose my home or so that it doesnt affect my credit or loose out on the fees for forclosure ( attorney fees, late fees, capital gains taxes ). Any one have any suggestions or ideas?

Open Question: New home Mortgage and refinancing?


My builder will pay my 5K or so closing costs if I use their mortgage company. Well, come to find out (6th months ago is why I got my first quote) the company is charging a pretty high interest rate.

Since they are paying my closing costs if I use them, could I refinance the house, let say in 6 months to a year, to another better company?

I am a resident of Texas and getting a divorce. Everything just happened yesterday so still in the begining stages. However, my father cosigner for a vehicle that is also in my wife's name (soon to be ex-wife). My name is not associated with this vehicle. My wife is the borrower and my father is the cosigner. Is there any way to get my father released from this auto loan based on us getting a divorce? I can't afford to take the car away and don't plan to try and take the vehicle. My wife would not purposely skip out on payments but I don't want my parent remaining connected to an ex-wives account. We are giong to try and get it refinanced just under her name but her credit is not great and I doubt she would get approved by herself. What if she doesn't have someone to cosign for the refinance? I owe about 8k on my acura and its worth around 17k. I am financing with capitalone blank check program. If i want to sell my car before i pay it off, does the buyer send capitalone the whole amount or just the amount that i owe? will they send me a difference?

Or did you finance one? About 80% of the guys I know with Harleys used the cash out from a home refinance towards the purchase of their Harley. It seems like such a solid investment idea. Plus not many people have $20k + just sitting around to buy one. It could be one of the reasons Harley stock has done so well over the last 10 years.

My wife and I have owned our house for about 5 1/2 years, but we refinanced about 2 years ago. The terms of our loan are really good for us (30yr fixed 6.5%).

However, this year has been terrible for us financially. My wife's income fell by about $20,000 annually, and then we had some friends in a very bad car accident in which some of their family died, and we helped out financially. Then my son needed massive dental work. Then we had more medical expenses. Then the water heater exploded. And so on...

So, we have fallen behind on our credit card bills. The car payments and mortgage still have perfect payment history, but the credit cards are a wreck. And, since we were barely getting by to start with, we have no prospect of getting them caught up any time soon. So our credit sucks now...

Now, my work is moving me about 400 miles away. I don't think we'll be able to get a new mortgage to buy another house, but we don't want to have to go back to renting.

What should we do?

Open Question: Will a mortgage company refinance a loan currently in forebearance?


I've got a mortgage that is in a repayment status under a forebearance plan, but they want to modify the loan and put what I currently owe on the back of the loan. I want to know if another mortgage company will refinance me with the loan currently being behind (although payments have been made as agreed through the plan).

I just finished consolidating all of my revolving debt into one single account. So, instead of the ~10 credit cards I used to have, now all of that debt has been refinanced into one account at a much lower interest rate. AND, my credit score should improve! WOOOHOOOO!

Open Question: Refinance - Web Closing?


I am about to refinance my mortgage with one of the biggest banks in the country. Interest rate is great. Closing fee is very minimal. They told me, I can do web closing or go to any of the branches. For web closing, I will have to give the closing company (an affiliate of the bank), the Power of Attorney and some body from the closing company will sign on my behalf. I will have to login at a scheduled time and some one from the closing company will walk me thru each of the document.

I have never heard about this. Has anyone heard anything like this?
